Please read these terms carefully before entering any competition on our website.

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website nitrouscompetitions.com ("the Website") and your participation in any competitions, prize draws or instant win games operated through the Website.

The Website is operated by Nitrous Competitions Ltd, a company registered in England and Wales under Company Number 11316541, with its registered office at Unit A - 82 James Carter Road, Mildenhall, Bury St. Edmunds, IP28 7DE ("we", "us", "our", "the Company", "the Promoter").

For the purposes of these Terms, the following definitions apply:

  • "Competition" means any prize competition, prize draw, or instant win game listed on the Website.
  • "Entry" or "Ticket" means a single entry into a Competition, purchased via the Website.
  • "Draw" means the process by which a winner is selected for a Competition.
  • "Prize" means the item, vehicle, cash sum, or other reward offered as the prize for a Competition.
  • "Entrant" or "You" means any person who purchases a Ticket and enters a Competition.
  • "Skill Question" means the multiple-choice question that must be answered correctly in order to validate an Entry.
  • "Cash Alternative" means the cash sum offered as an alternative to the physical Prize, where stated on the Competition page.

2. Acceptance of Terms

By accessing or using the Website, creating an account, or purchasing a Ticket, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website or enter any Competition.

These Terms should be read alongside our Privacy Policy, Cookie Policy, and any individual Competition Terms and Conditions that may apply to specific Competitions. In the event of any conflict, the specific Competition Terms shall prevail over these general Terms in relation to that Competition.

3. Eligibility

To enter any Competition on the Website, you must meet all of the following criteria:

  • You must be aged 18 years or over at the time of entry. We reserve the right to request proof of age before releasing any Prize.
  • You must be a resident of the United Kingdom (England, Wales, Scotland, or Northern Ireland) with a valid UK postal address for Prize delivery purposes.
  • You must not be an employee, director, officer, or agent of Nitrous Competitions Ltd, nor a member of their immediate family or household.
  • You must not be an employee, contractor, or affiliate of any company involved in the supply, administration, or fulfilment of the Competition or Prize.
  • You must not have been previously banned or excluded from the Website by us.

We reserve the right to verify your eligibility at any time. If you are found to be ineligible, your Entries will be voided, any Prize awarded will be forfeited, and no refund will be given.

4. Account Registration

To enter a Competition, you must create an account on the Website. When registering, you agree to:

  • Provide accurate, current, and complete information, including your full legal name, valid email address, date of birth, telephone number, and UK postal address.
  • Maintain and update your account information to keep it accurate and current.
  • Keep your login credentials confidential and not share them with any other person.
  • Accept full responsibility for all activity that occurs under your account.
  • Notify us immediately if you suspect any unauthorised use of your account.

Each person is permitted to hold only one account. Creating multiple accounts is strictly prohibited and may result in the cancellation of all Entries, forfeiture of any Prizes, and permanent suspension from the Website. We reserve the right to merge, suspend, or terminate duplicate accounts without notice.

We reserve the right to suspend or terminate your account at our sole discretion if we reasonably believe that you have breached these Terms or have engaged in fraudulent or abusive behaviour.

5. Competition Entry

To enter a Competition, you must:

  1. Select the Competition you wish to enter on the Website.
  2. Choose the number of Tickets you wish to purchase, subject to any maximum ticket limit stated on the Competition page.
  3. Add Tickets to your cart and proceed to checkout.
  4. Correctly answer the Skill Question associated with the Competition. Each Competition requires a correct answer to a multiple-choice question as a condition of entry, in compliance with UK competition law. Entries submitted with an incorrect answer will not be valid, and no refund will be issued.
  5. Complete payment for the total cost of your Tickets.

Upon successful completion of the above steps, your Entry will be confirmed by email. Each Ticket purchased and validated entitles you to one entry into the relevant Competition. Tickets are allocated sequentially and your ticket number(s) will be displayed in your account and on your confirmation email.

Each Competition may specify a maximum number of Tickets per person. Any attempts to exceed this limit (including through multiple accounts) will result in excess Entries being voided.

Once a Ticket has been purchased and the Skill Question answered, the Entry is final. Entries cannot be transferred, exchanged, or refunded except as required by law.

6. Pricing & Payment

All prices on the Website are displayed in pounds sterling (GBP) and are inclusive of VAT where applicable.

We accept the following payment methods:

  • Visa, Mastercard, and American Express debit and credit cards
  • PayPal
  • Apple Pay
  • Google Pay

Payment must be made in full at the time of purchase. All payments are processed securely through our third-party payment processor. We do not store your full card details on our servers.

Ticket prices may vary between Competitions. Bulk purchase discounts may be offered and will be clearly stated on the Competition page. We reserve the right to change prices at any time, but changes will not affect Tickets already purchased.

Refund Policy

Due to the nature of competition entries, refunds are not available once a Ticket has been purchased and the Skill Question has been answered. By purchasing a Ticket and answering the Skill Question, you acknowledge that the service has been fully performed and you expressly consent to the loss of your right of withdrawal under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If you experience a technical issue during purchase that results in payment being taken without an Entry being recorded, please contact us at info@nitrouscompetitions.com and we will investigate and, where appropriate, either issue the Entry or provide a refund.

7. Draw Procedures

All Draws are conducted live on our Facebook page (facebook.com/nitrouscompetitions) for full transparency.

Winners are selected using Google's Random Number Generator. The randomly generated number corresponds to a Ticket number from the list of valid Entries. The holder of that Ticket is declared the winner.

Key draw procedures:

  • Each Competition has a scheduled draw date displayed on the Competition page. Draws will take place on or around the stated date.
  • If all Tickets for a Competition sell out before the scheduled draw date, we reserve the right to bring the draw forward. Entrants will be notified of any change to the draw date via email and social media.
  • If a Competition does not sell out by the scheduled draw date, the draw will still take place and all purchased Entries will remain valid. Alternatively, we may extend the draw date, offer additional discounts, or reduce the Prize to a cash alternative at our discretion.
  • The full entry list for each Competition is published on the Website before the draw, showing all valid Ticket numbers and corresponding entrant names.
  • Draw results are published on the Website and announced on our social media channels.

The Promoter's decision in respect of all matters relating to the draw is final and binding, and no correspondence will be entered into.

8. Prizes

Prizes are as described on the individual Competition page at the time of entry. We reserve the right to substitute a Prize of equal or greater value if the stated Prize becomes unavailable for reasons beyond our control.

  • Cash Prizes: Cash prizes are paid via bank transfer to a UK bank account in the winner's name within 48 hours of the winner being verified.
  • Physical Prizes: Physical prizes (including vehicles, technology, and other goods) will be delivered to the winner's UK address within 7 to 14 working days of winner verification, unless otherwise stated. Delivery of vehicles may take up to 28 working days depending on registration and logistics.
  • Cash Alternative: Where a Cash Alternative is stated on the Competition page, the winner may choose to receive the cash sum instead of the physical Prize. The Cash Alternative amount is fixed at the time of the Competition launch and is non-negotiable.
  • Tax: All Prizes from Nitrous Competitions are tax-free in the United Kingdom. Winners receive the full stated Prize value with no deductions. Winners are responsible for any ongoing costs associated with a Prize (e.g., vehicle insurance, road tax, maintenance).

Winner Verification

Winners will be contacted via the email address and/or telephone number registered to their account. Winners must respond within 14 days of notification to claim their Prize. Failure to respond within this period may result in the Prize being forfeited and a new winner being drawn.

We may require winners to provide proof of identity and age (e.g., valid passport or driving licence) before releasing any Prize. Winners may also be required to participate in reasonable publicity activities, including photographs and social media posts, as a condition of Prize acceptance.

9. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, audio, video, software, and code, is the property of Nitrous Competitions Ltd or its licensors and is protected by United Kingdom and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Website without our prior written consent.

The Nitrous Competitions name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Nitrous Competitions Ltd. You may not use these marks without our prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law:

  • The Website is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding the Website's availability, accuracy, or fitness for a particular purpose.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website or participation in any Competition.
  • Our total aggregate liability to you in respect of any claims arising from your use of the Website or participation in any Competition shall not exceed the total amount paid by you for Tickets in the preceding 12-month period.
  • We shall not be liable for any loss or damage caused by events beyond our reasonable control, including but not limited to: acts of God, fire, flood, pandemic, government action, internet or telecommunications failure, power failure, or any other force majeure event.
  • We are not responsible for any technical failures, including website downtime, server errors, email delivery failures, or payment processing issues, although we will make reasonable efforts to resolve such issues promptly.

Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded by applicable law.

11. Privacy

We take the protection of your personal data seriously. All personal information collected through the Website is processed in accordance with our Privacy Policy, the UK General Data Protection Regulation (UK GDPR), and the Data Protection Act 2018.

By creating an account and entering Competitions, you acknowledge that you have read and understood our Privacy Policy. We encourage you to review it regularly.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon publication on the Website. The "Last updated" date at the top of this page will be revised accordingly.

It is your responsibility to review these Terms periodically. Your continued use of the Website or participation in any Competition after changes are published constitutes your acceptance of the revised Terms.

Material changes to these Terms will be communicated to registered users via email where practicable. However, the published version on the Website shall always be the definitive version.

13. Governing Law

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms. Nothing in this clause shall limit your statutory rights as a consumer under applicable law.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
